The Grower/Contractor agrees to: deliver to the company the entire production of the area described on the sales contract and as stated on this contract.

Movement: 1st August 2009 to 31st July 2011 at Buyers Call unless otherwise specified.

Price: (A) The Grower/Contractor selects from Scheme A, B or C. Where the price paid is a premium it will be over the base price of HGCA local ex farm feed wheat price for the week of movement / delivery.
Scheme A - Harvest movement = 20% premium over base price*
Scheme B - Forward movement = 30% premium over base price*
Scheme C – Fixed price contracts available on application, movement by end December 2009.
*Up to a maximum base price of £140.00 pt, thereafter less 0.5% of the premium for every £1.00 pt over £140.00 pt.

Quality: Bright colour, free from infestation, smell, ergot, sprouted or mouldy grains and of marketable quality and free from straw and debris, the oats to be pre-cleaned on farm.

Husked Oat Content: Maximum 4.0% husked grained oats by weight. Thereafter £3.00 per tonne deduction per 1% husked oat content or part thereof. Over 8% by negotiation.

Moisture: Maximum 14.0%. An allowance of £7.00 per tonne will be charged for moistures up to 15.0% and thereafter an additional £3.00 per tonne per 1.0% moisture or part thereof, plus any redirection and storage costs if incurred.

Admixture: A maximum of 2.0% other cereals, weed seeds, discoloured grains and inert matter. Thereafter £2.00 price deduction for each additional 1.0% admixture or part thereof. Over 8% by negotiation.

Specific Weight: A minimum of 65 kg/HL. Thereafter £2.00 per each kg/HL below 65. Under 60 kg/HL by negotiation.

Treatments: If possible, not to have been subject to chemical treatment post harvest. Any chemical treatment must be notified to us and be an approved chemical for use on feed grain.

Screening Content: Losses over a 1.8mm sieve in excess of 10% will be liable to a deduction of £2.00 per each percent or part thereof over 10%.

Collections: The price is based on 29 tonne full vehicles. Cap load charges will be passed to the Grower. Buyers weights are final. Time taken to load one full vehicle should be 2 hours maximum. Waiting time and/or breakdowns to be charged to the Grower.

Payment: The Company will pay for goods 28 days from average date of movement or standard trade terms where applicable.

Sampling: Samples to be submitted by the Grower/Contractor to the Company as soon as the crop is harvested dry and in marketable condition and no later than 15th October after harvest.

Deliveries: Oats which do not meet the above standard may be accepted with a price allowance. It is express in this contract that all grain produced must be delivered to the buyer at his discretion. Notification of claims will be advised by the company within five working days after date of uplift.

Arbitration: Any dispute arising out of this contract shall be referred to arbitration rules agreed between AIC and the National Farmers Union. All parties whether members of such organisations or not shall on signing or accepting this contract shall be deemed to have knowledge of such rules and to have elected to be bound thereby.

Inspection: The Company reserves the right to inspect details of all contracted crops and to visit them at their discretion.

The Food Hygiene (England / Wales / Scotland) Regulations 2006: It is the Sellers responsibility to comply with the regulations of the above act and all other current regulations.

Product Liability: The Grower undertakes that the produce of the Contract delivered to the Merchant emanates from the area specified and sown with the variety of Naked Oat seed supplied as detailed in the ‘seed requirement’ section of this contract. The Grower hereby undertakes to save harmless and keep indemnified the Merchant against any loss or damage which may result from, or any claim made against the Merchant as a consequence of, failure to comply in all respects with this requirement.

Terms & Conditions: Except where inconsistent with the terms and conditions shown above, the current AIC 1 or 2 grain contract is deemed to apply and forms part of this contract. In all cases English law applies.

All crops to be grown within the ‘Assured Combinable Crop Schemes’ (ACCS).

This contract is non-transferable except with the consent of the company.
